Apollon Engine Privacy and GDPR Agreement

This Privacy and GDPR Agreement ("Agreement") is a contract between you ("Licensee", "User", or "you") and Apollon Engine ("Licensor", "Apollon Engine", "we"). This agreement regulates the permissions and responsibilities necessary for the collection, processing, and storage of visual and text data from the user, in accordance with the requirements of the KVKK and GDPR.

1. Definitions

The following terms used in this agreement shall have the following meanings:

- "KVKK": Law on Protection of Personal Data

- "GDPR": General Data Protection Regulation

- "Licensee": The individual or organization using Apollon Engine and accepting this agreement.

- "Licensor": The operator of Apollon Engine providing the services and accepting this agreement.

2. Data Processing Permissions

The Licensee is responsible for obtaining the necessary permissions from the user for the collection, processing, and storage of visual and text data using Apollon Engine.

3. Data Processing Process

The Licensee will process the data collected from the user in compliance with the provisions of KVKK and GDPR. This processing may include activities such as analysis of visual and text data, data storage, and generating user-related statistics.

4. Data Security

The Licensee is obligated to take the security measures required by KVKK and GDPR. Appropriate technical and organizational measures must be taken to ensure the protection of data against unauthorized access, alteration, disclosure, or deletion risks.

5. Data Retention Period

The Licensee will retain the data only for the specified period in compliance with KVKK and GDPR. The retention period should be determined based on the business needs, applicable legislation, and the user's consent.

6. Purposes of Data Processing

The Licensee may process the data collected from the user only for specific purposes. These purposes may include data analysis, improvement of services, customization of user experience, and compliance with legal obligations.

7. User Responsibilities

The Licensee shall inform the user about the purpose of data processing, obtain necessary consents, and ensure that the user understands their rights regarding their personal data. The Licensee shall also inform the user about any third parties with whom the data may be shared and obtain separate consents if required.

8. User Rights

The user has the right to access, rectify, erase, restrict the processing, and object to the processing of their personal data. The Licensee shall provide mechanisms for users to exercise these rights and handle user requests promptly and in accordance with KVKK and GDPR.

9. Data Transfers

The Licensee shall ensure that any transfer of data to third parties, including international transfers, complies with the requirements of KVKK and GDPR. Appropriate safeguards, such as standard contractual clauses or Privacy Shield certification, should be in place for such transfers.

10. Data Breach Notification

In the event of a data breach, the Licensee shall promptly notify the relevant authorities and affected users in accordance with KVKK and GDPR requirements. The Licensee shall also take necessary measures to mitigate the impact of the data breach and prevent further unauthorized access.

11. Agreement Modification

Apollon Engine reserves the right to modify this Agreement at any time. Any modifications will be communicated to the Licensee, and continued use of the services after the modifications indicate acceptance of the updated terms.

12. Governing Law
